Not how these things are viewed. The bar has an affirmative legal responsibility to the patron, especially if visibly drunk.

This maybe true. When was the last time you went to a social event where alcohol was not prominently displayed/served?
A bar has certain responsibilities. Some of those are by law, others under its licensure and others under its liability policy. These types of cases have been litigated for at least 35 years. When cases have not been settled, the courts have been clear as to the establishment's responsibilities.
This women did not suddenly become drunk. And, given the place and her age, the bar likely knew of her habits.

Pet peeve of mine, I am a non drinker. So tired of alcohol given as the excuse. What did you think it was going to do, give you super powers? It's going to affect your balance, your mental capacity. You drink and having any issues, it's on you. You chose to drink.
I'm using 'you' as a reference and not specifically meaning you directly.

The law does not care if you agree. Unless changed, it is what it is.
I do not disagree with most of what you state about alcohol, but folks do not magically become drunk upon entering an establishment. She had to have been plastered for some time before she took a header off the stool. A bummer re her current state, but she made the decision to start drinking and the barkeep kept serving her for some time before she became a jellyfish.

Double standards apply. You can be too drunk to consent to sex, which holds up in court, but you get behind that wheel and no matter how drunk, it's the drunk person's fault. So which is it, are we liable or not for our own actions?

Yet another drunk filing a dram shop action... when will bars learn to stop over-serving patrons? The liability policy probably will cover whatever this is settled for and the barfly will continue to be served as if nothing ever happened. And so it goes...
