If the thief has an iphone, woudn't they be alerted of the airtag? Granted if you hide it well, it could be tough to find but still.

No. The AirTag is connected to your phone. I don’t get alerted on my phone every time I am around someone else’s airtag

That's because other people's airtag isn't following you for too long. But I get notified all the time if I'm with a friend, and their airtag is in my car.

It’s for sure a feature Apple has added
It only goes off if a another AirTag is close to your device for a certain number of hours or while driving or something
Apple added it because AirTags were immediately being used to track and stalk people
